Third Circuit hears the appeal in Thomson Reuters v. Ross

The Third Circuit heard oral argument in Thomson Reuters v. Ross (No. 25-2153) in June 2026. The appeal challenges the February 2025 district court decision that rejected Ross Intelligence’s fair use defense for using Westlaw content to train an AI legal research tool.

Whatever the panel decides will be the first federal appellate word on whether training a model on copyrighted material is fair use. Until then, how models may lawfully be built is not fixed.
